On the Verge

Jeff and Anne are about to build their dream house. We hope. After what seemed like plenty-enough difficulties just finding the land and getting it under contract, we were supposed to close yesterday.

Instead, an hour and a half before closing, we got a call not to bother driving over - there’s a possible problem with the title. The current owner bought it from a man with seven kids, and one of the sons had power of attorney and signed the paperwork. Our closing attorney apparently doesn’t feel comfortable that the son was properly authorized by the father and/or by the six siblings, so he’s checking with the attorney who closed that previous sale to see what additional information is available.

I would have thought that, if you trust somebody enough to give them power of attorney, you’re stuck with what they do in your name. And doesn’t power of attorney quit working once you die? But perhaps Son was taking care of Dad’s affairs once Dad was no longer able… Anyway, now Dad is gone, so we can’t just ask him. If the previous attorney’s info doesn’t clear it up, the six siblings will have to be found and asked.

It’s the seller’s problem to clean up, but we’re stuck waiting too. Nobody will give us an estimate of when it will be fixed - or even an estimate of when we’ll get an estimate.
